In this seminar, Michèle Finck will examine the complex relationship between blockchain technology and the GDPR. We will investigate the GDPR, a legal framework designed for centralized data silos, which cannot easily be applied to contexts where data is collected, stored and processed in a decentralized manner. The seminar will highlight various resulting points of tension. More broadly, this topic provides us with an opportunity to discuss the rationale behind and future of the GDPR and ponder the complex relationship between law and technological innovation.
Michèle Finck is a Fellow at the UCL Centre for Blockchain Technology, a Senior Research Fellow at Max Planck Institute for Innovation and a Lecturer in Law at the University of Oxford. Originally from Luxembourg, Michèle studied law at King´s College London and at the Sorbonne. She holds an LLM degree from the European University Institute and a doctorate in law from the University of Oxford. Michèle is a lecturer in EU law at Keble College (University of Oxford) (since 2013) and was a fellow at the London School of Economics from 2015-17. She was a visiting researcher at New York University from 2013-14.
Michèle’s research focuses primarily on digital platforms and blockchain technology as well as EU law. She is an editor of the Cambridge Handbook on the Law and Regulation of the Sharing Economy (together with Nestor Davidson and John Infranca) and the author of ‘Subnational Authorities in EU Law’ (OUP 2017).
In Michèle’s upcoming book titled “Blockchain Regulation and Governance in Europe”, she examines the relationship between blockchain technology and EU law and introduces the theme of blockchain governance. The book provides a general introduction to blockchains as both a regulatable and a regulatory technology and outlines the interaction between distributed ledger technology and specific areas of EU law, such as the General Data Protection Regulation.
